• Domain Registration: Domain registration and management services
• Technical Support: 24/7 customer support for all hosting-related issues

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

3. Account Registration & Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

• You must provide a valid email address and contact information
• You are responsible for safeguarding your password and account access
• You must notify us immediately of any unauthorized access to your account
• You may not use another person's account without permission
• You must not create multiple accounts to abuse promotions or services

4. Payment Terms & Billing

By purchasing our services, you agree to pay all applicable fees and charges. Our payment terms include:

• Billing Cycle: Services are billed in advance on a monthly, quarterly, semi-annual, or annual basis
• Payment Methods: We accept various payment methods including bKash, Nagad, Rocket, and bank transfers
• Late Payments: Services may be suspended if payment is not received within the grace period

5. Prohibited Content & Usage Policy

To maintain the stability and security of our servers, hosting the following types of websites or content is strictly prohibited:

• Video Streaming: YouTube clones, movie streaming, or any heavy video-sharing sites
• Social Media: Heavy social networking scripts similar to Facebook or Twitter
• Live Broadcasts: TV channel streaming or live sports broadcasting websites
• Malicious Scripts: SMS/Mail bombing, spamming, phishing, or hacking tools
• File Storage: Play Store clones, App Stores, or sites created solely for file downloading
• Adult Content & Gambling: Any form of adult content or betting/gambling websites
• Illegal Activities: Piracy, warez, torrent sites, or any content violating copyright laws
• Proxy & VPN: Open proxy services or VPN services that facilitate illegal activities

6. Resource Usage & File Policy

To ensure proper server performance for all users, customers must adhere to the following rules:

• ZIP Archives: After completing website setup or file uploads, the original ZIP file must be deleted directly from the file manager
• Unnecessary Files: Hosting is intended solely for running websites. Storing personal file backups or unnecessary data is prohibited
• Resource Limits: If any website consumes excessive CPU or RAM and causes issues for other users on the server, the authority reserves the right to temporarily suspend the site
• Inode Limits: Each hosting package has an inode limit. Exceeding this limit may result in service suspension
• Bandwidth: Fair usage policy applies. Excessive bandwidth usage may result in throttling or suspension
• Backup Responsibility: Customers are responsible for maintaining their own backups. We recommend regular backup schedules

7. Anti-Scam & Fraud Policy

Nex Host follows a strict zero-tolerance policy against scamming and fraudulent activities:

• If anyone falls victim to a scam from a website hosted on our server and the victim can provide accurate and acceptable evidence, the associated hosting account will be suspended immediately without prior notice
• No information or backups will be provided to scammers, and legal action may be taken if necessary
• Any account involved in phishing, identity theft, or financial fraud will be permanently terminated
• We cooperate fully with law enforcement agencies in investigating fraudulent activities

8. Domain Registration Terms

When you register a domain through Nex Host, the following additional terms apply:

• Ownership: You retain ownership of your domain name, but must comply with ICANN regulations
• Accurate Information: You must provide accurate WHOIS contact information
• Renewal: Domain renewals must be paid before the expiration date to avoid loss of domain
• Transfer: Domain transfers require authorization codes and may take 5-7 days to complete
• Disputes: Domain disputes are subject to ICANN's UDRP (Uniform Domain-Name Dispute-Resolution Policy)

9. Service Level & Uptime

We strive to provide reliable hosting services with high uptime. Our service level commitments include:

• Uptime Guarantee: We aim for 99.9% network uptime (excluding scheduled maintenance)
• Scheduled Maintenance: We will provide advance notice for planned maintenance when possible
• Support Response: Our support team responds to tickets within 24 hours
• Emergency Support: Critical issues are prioritized and addressed as quickly as possible

10. Cancellation & Refund Policy

We want you to be satisfied with our services. Our cancellation and refund policy includes:

• Cancellation Request: You may cancel your service at any time through your client area or by contacting support
• Refund Period: Refund requests must be made within 7 days of initial purchase (not applicable to renewals)
• Non-Refundable Items: Domain registrations, custom setup fees, and promotional offers are non-refundable
• Pro-rated Refunds: Refunds are calculated on a pro-rated basis for the unused portion of the service
• Account Suspension: Accounts suspended for policy violations are not eligible for refunds

11. Limitation of Liability

To the maximum extent permitted by law, Nex Host shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages resulting from service interruptions, delays, or failures
• Any damages resulting from unauthorized access to your data
• Any damages caused by third-party services or products linked through our services

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

12. Intellectual Property

All content, features, and functionality of our services are owned by Nex Host and are protected by international copyright, trademark, and other intellectual property laws.

• You retain ownership of the content you upload to your hosting account
• You grant us a license to host and transmit your content as necessary to provide our services
• You must not infringe on the intellectual property rights of others
• We reserve the right to remove content that violates intellectual property rights

13. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms and Conditions
• Non-payment of fees
• Fraudulent or illegal activities
• Abuse of server resources
• Hosting prohibited content

Upon termination, your right to use our services will cease immediately. You may request a copy of your data before termination, subject to our data retention policies.

14. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by:

• Posting the new Terms and Conditions on this page
• Updating the "Last Updated" date at the bottom
• Sending an email notification to your registered email address (for significant changes)

Your continued use of our services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using our services.

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

Any disputes arising from these terms or our services shall be resolved in the courts of Bangladesh. You consent to the jurisdiction of such courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
